 Abstract

Criminal law protection of reproductive rights is one of the most important aspects of demographic policy, which should also be key in determining the main directions of criminal policy. At present, there is no normative consolidation of even the term "reproductive rights". In this regard, their protection is carried out in accordance with the general rules for the protection of human rights established by the current legislation. However, reproductive rights have their own specifics, which should be taken into account in determining effective means and methods of their protection. Only in this case, you can count on the effectiveness of such protection. Unfortunately, the criminal legislation does not define the elements of crimes that infringe on reproductive rights. Therefore, it can be stated that criminal protection of reproductive rights is currently a blind spot for criminal policy. One of the tasks of today, in the light of the existing demographic policy aimed at creating conditions for population growth, is the formation of a criminal policy aimed at determining methods and means of protecting human reproductive rights. This implies the need to define criteria for distinguishing reproductive rights, as an object of criminal legal protection, from other human and civil rights. This issue is also important in determining the key points in criminal policy, since it determines the development of criminal legislation and, as a result, the definition of measures to prevent and prevent criminal encroachments on reproductive rights. All these problems were the subject of consideration of the submitted article.
